1. Who we are and what this Privacy Notice covers
Pathbuilder is a service that helps startup founders prepare for a successful acquisition. Our top priority is the security and privacy of our users’ data.
This Privacy Notice explains what personal data we collect and process when you use the Pathbuilder Platform, Services, and website. This Privacy Notice also explains how we use such personal data, who we share it with, and the choices you have.
“Personal Data” means information that identifies or relates to an individual.
Our two roles. Pathbuilder handles Personal Data in two different roles. When we decide why and how Personal Data is used, for example your account and subscription information and how you use the Pathbuilder Platform, we act as a data controller. When our customers enter information about other people into the Pathbuilder Platform, for example the names, contact details, companies, and notes they keep on investors, acquirers, and introducers, we process that information on our customer’s behalf and only on their instructions. In that role we act as a data processor, and our customer is the data controller.
This Privacy Notice applies only where Pathbuilder acts as a data controller. Where we act as a data processor, our customer is solely responsible for how that Personal Data is collected, used, and shared, including giving any notices and obtaining any consents that the law requires. If you have questions about how one of our customers handles your Personal Data, please contact that customer directly.
2. Information we collect
We collect different types of Personal Data and information during your interactions with Pathbuilder, including through the following methods:
2.1 Visiting our website. We may collect Personal Data from you through forms on our website. Such Personal Data may include name, address, title, company name and address, phone number, and email address. Such data may be collected through contact forms, event registrations, mailing list subscriptions, or other pages on our website.
2.2 Account and subscription information. When you sign up for a Pathbuilder account we collect Personal Data, such as name, address, title, company name and address, phone number, and email address.
2.3 Payment processing. We use secure and reputable third party payment services to process personal and financial data. We do not store credit card or bank account numbers.
2.4 Testimonials. We will only publish testimonials with your authorization. Testimonials may include your name and other Personal Data in the testimonial.
2.5 Usage data. We collect usage data when you interact with the Pathbuilder Platform. Usage data may include information about your use of Pathbuilder, such as what workflows your account has used, what features you’ve accessed, and other similar information.
2.6 Log files, internet or electronic network activity, and device information. We collect information from logs and usage analytics tools in order to understand your needs and improve Pathbuilder. This information includes device information, IP address, approximate location, clicks, scrolls, performance data, usage settings.
2.7 Third party integrations. If you choose to connect third party integrations or utilize a third party authentication service (e.g. sign in through Google) those integrations may collect and share your Personal Data. This Privacy Notice does not apply to such integrated service providers and we are not responsible for their practices or policies. It is your responsibility to carefully review any third party integrations you authorize and the permissions that you grant to those third party integrations.
We do not collect “sensitive personal data” or “sensitive personal information,” within the meaning of applicable data privacy laws, with the purpose of inferring characteristics about you.
3. How we use information
3.1 To provide the Pathbuilder Platform and Services. We use the account and subscription information to provide you with the Pathbuilder Platform and Services. For example, your email address is used to create your user account in order for you to log in.

3.3 Improvements. We use the information you provide us to improve our products and communications with you. To do so, we analyze usage trends and navigations. We may publish aggregated statistical information about how the Pathbuilder Platform and Services are being used, and such statistical information will never identify individual users or customers.
3.4 Customer support and quality assurance. We use the information to allow our customer support personnel to provide the best level of assistance and continuously improve their knowledge. We may use tools to record and monitor certain user interactions. We use the information to perform quality assurance.
3.5 To market our services. We use personal information in the marketing and promotion of our services, including through email. You may opt out of receiving marketing messages by following the instructions at the bottom of each such message that you receive from us. If you have a call with a Pathbuilder representative we may record and transcribe this call, after notification to you that the call is being recorded and the opportunity for you to decline having the call recorded.
3.6 Legal basis. If you are an individual located in the United Kingdom (“UK”) or European Economic Area (“EEA”), or in another relevant jurisdiction, we process your Personal Data where we have a legal basis for doing so. Our legal basis for collecting and using the Personal Data depends on the nature of the processing activity. However, we will normally collect and process your Personal Data only where we need it to provide you with the Pathbuilder Platform, Services, or website (including customer support and any features); where it satisfies a legitimate interest of Pathbuilder (which is not overridden by your data protection interests and rights), where you have given us consent to do so, or where we have a legal obligation to do so.
4. Who we share it with
4.1 Service providers. We may share Personal Data with our third party service providers, for example those who provide hosting, storage, development, maintenance, marketing, analytics, customer support, and other services for us. These service providers are contractually required to maintain the confidentiality of such information.
4.2 Partners. Subject to your consent or as otherwise permitted by applicable law or contract, we may share your Personal Data with trusted partners. For example, if you sign up for one of our events, and the terms of that event specify that you consent to sharing certain Personal Data with the event co-sponsors, we may share that information.
4.3 Change of ownership. If we (or our assets) were to be acquired by another company, any Personal Data we process would be disclosed and transferred to the acquirer, successor, or assignee.
4.4 Legal compliance. We may disclose your Personal Data if required by law or if we believe that the disclosure or use of your Personal Data is necessary to comply with applicable laws, court orders, subpoenas, or other legal process; prevent fraud or unlawful activity, or protect our rights.
5. How long we keep it
We retain Personal Data that you provide to us as long as we have a legitimate business need to do so. After that time, your Personal Data will be deleted or anonymized. Should you wish to request an earlier deletion of your Personal Data you may do so by contacting hello@pathbuilderhq.com.
